Travelers Not Required To Pay $500M In Asbestos Settlements

Koeltl of the Southern District of New York wrote in a Feb. 29 decision.

Asbestos is a generic name for six minerals in nature that were used during much of the 20th century in the manufacture of thousands of products: wallboard, floor tiles, roofing shingles, ceiling tiles, cement, textile products, automotive brakes, paper products and other items, according to the federal Centers for Disease Control and Prevention and the Environmental Protection Agency.

Asbestos materials can break apart into microscopic particles easily inhaled, and people who were exposed to asbestos on a regular basis for work have developed several types of life-threatening diseases, including lung cancer, according to the CDC.

The federal government has banned asbestos for different uses in several stages starting in 1973 through the National Emissions Standards for Hazardous Air Pollutants.

The three settlements in the most recent lawsuit are separate from, and in addition to, an initial settlement in 1986 when Travelers agreed to pay $80 million to a bankruptcy estate to cover Manville's asbestos liabilities. The 1986 court orders intended "to fully and finally extricate Travelers from the Manville morass," according to court files.

Many new lawsuits emerged after the 1986 court orders, however, with new victims pursuing different legal claims based on state consumer statutes and common law theories. Those lawsuits were based on the underlying premise that Travelers "acquired knowledge about the dangers of asbestos from claims in the 1950s, recognized the potential for future escalation of asbestos litigation and began to influence Manville's purported failure to disclose knowledge about asbestos hazards," court documents say.

The lawsuits filed after 1986 were bundled by U.S. Bankruptcy Court and mediated by Cuomo.

THE idea of making things invisible has long hovered on the boundary between science fiction and magical fantasy. The suggestion that things really can be made invisible is not completely new. In 2006 Sir John Pendry of Imperial College, London, and Ulf Leonhardt of the University of St Andrews independently worked out how it might be done in a limited way. Their idea,Handmade oil paintings for sale at museum quality, known as transformation optics, was to map the electrical and magnetic fields that make up light waves on to a two- or three-dimensional grid and then distort that grid in order to alter the trajectory of the light, using the sort of mathematics that describe the way light is bent by massive objects such as black holes. Simple in theory. But rather harder in practice. Dr Guenneau and his colleagues, though, do not have to worry about wavelengths. They have shown that variations in a quantity called diffusivity can do for heat what multiple refractive indices do for light. Dr Guenneau’s team applied the mathematics of transformation optics to the equations describing thermal diffusion and found that the transformed equations do, indeed, make physical sense. They therefore realised that it should be possible to distort the space through which heat flows by manipulating diffusivity. This insight allowed them to design a thermal invisibility cloak consisting of 20 concentric rings of varying diffusivity that would isolate a central circular region from incoming heat, making it the best insulator imaginable.

Unlike existing optical cloaking devices, which are little more than toys, Dr Guenneau’s idea would have an immediate practical application: protecting heat-sensitive components in electronic devices. It might also be able to confuse thermal-imaging equipment, which would make it of great interest to the world’s armies, navies and air forces. That, though, is a speculative idea.

There's a goldmine of material there—parenthood, public schools, rat race, aging and relationships—and plenty that guys will laugh at.

Most of this Canadian quartet has done time in The Second City in Toronto, legendary at producing comedians with a facile ability at humorous characterizations. Within seconds of a sketch each could swiftly convey the core of personality with bits of body language, facial expressions and vocal tone, especially tough since most of the characters are relatively normal, unlike the exaggerated ones that populate Saturday Night Live. Women Fully Clothed starts out with two very strong skits. In one, a trio of over-achieving ex-careerists transferred their boardroom behavior to a school-mom meeting. Overly sincere vows about the joys of being stay-at-home moms clashed with sniping comments revealing competiveness and pecking order obsessions. The comedians showcased a stunningly wide array of emotion, including Kathryn Greenwood devolving from confident young mother to tearful begging as the sole non-businesswoman who desired to move out of her toy-washing gulag assignment into the more prestigious role as assistant to the pizza mom. The always-comedic Jayne Eastwood, one of the wilder women of My Big Fat Greek Wedding with her unrepentant shock of frizzy hair, graced the skit as the mom who birthed triplets late in life and could not avoid falling asleep.

Surprisingly deep was a funeral skit. It first seemed to be about age-related social mores, with the constant Tweeting of youngest member Teresa Pavlinek repulsing the older Eastwood. The sketch evolved into Pavlinek and Greenwood trying to stay mournful but continuing to veer into chattiness, finally admitting they never liked the deceased and giving into a good laugh at her preposterous death. Guilt-tripping themselves into getting back "into the moment," they deftly slide into a moment of acute awareness of their own mortality and back out again before heading to the closest bar.

Eastwood warbled about the insecurities of elderly love, relieved at her husband's assertion that "when I'm poking at the fire I'm not looking at the mantle." Twice the quartet triumphed in topics usually limited to men. The skit on hemorrhoids was blessedly short, and extremely funny, thanks to Greenwood's terrific voice inflection. A sketch about clothes shopping seemed quintessentially female, with Duke's superb physical humor as an aging sales lady whose unfiltered comments did nothing for sales. Telling the not-so-young Greenwood that her low-rider jeans did not produce booty cleavage but rather a plumber's crack, Greenwood launched into a wordless showcase of belly flab and love handles that had the audience rolling with laughter.

The stage was classic comedy improv setting with black background, four chairs and a stool. Coupled with black attire, the splash of costume color in last segments of show was welcome relief. Pianist/keyboardist Bob Derkach, former musical director at The Second City in Toronto, did a great job of musical accompaniment and keeping the show flowing with sound effects and interstitial noodling.

Viewpoint Bank is to be commended as sponsor of the Eisemann comedy series sponsor for the past several years, increasing the lineup from three shows to four. Comedy sponsors are hard to come by. STANDING in a beer tent outside George with strawberry-coloured cocktail in my hand listening to a one-man-band covering I'm On My Way To Amarillo, I wondered if following my instincts had been such a good idea after all.

My obsession with strawberries could be directly linked to my entering a nondescript corrugated- iron structure at Buffalo Hills game reserve near Plettenberg Bay one afternoon some days earlier.

We were herded through the dark doorway by bush-survival expert Kurdt Greenwood. Moments before he had been rubbing noses with a boomslang from his pet collection and I was curious to see what he had in mind next.

It turned out to be an attitude-shifting experience. As my eyes grew used to the dark, I could make out a battered copper urn complete with pigtail piping befitting any self-disrespecting hillbilly household.

Formerly the abode of infamous Garden Route adventurer and wildlife champion Jack Mudd, who secretly served citrus-mampoer as Jacks Jungle Juice from the bush still, it was now a more respectable, legalised venture under the banner of Nyati mampoer-liqueurs.

And Greenwood was dishing them out ice-cold. The buchu-and-apricot blend was pretty enticing. So was the whiff of naartjie emanating from the Van der Hum. The plum was good too. But I was smitten with the very first sip of the smooth strawberry-chilli combo. With a surprisingly delicate after-bite, it was everything a high-end mampoer-based bush liqueur should be.

The strawberry, much more so than the apple, is heaven sent. But, as I found out, it should not be taken lightly. And it is prone to deception.

For a start, it's not a berry. In the same way we are asked to believe that the dassie is most closely related to the elephant, we are expected to accept that the strawberry belongs to the rose family.

In the shop you can buy everything from strawberry body butter, jelly soap, hand lotion and bath jelly to strawberry-patterned bookmarks, candles, dishcloths, necklaces and earrings.

Everywhere strawberry icecreams, slush, yoghurts, syrups and sorbets, as well as jams, condiments and salad-splashes, line the shelves alongside fridge magnets, baby-slippers, greeting cards, faux strawberry lips and the obligatory strawberry T-shirts. There's even a basket filled with strawberry rugby balls.

And of course Redberry's very own strawberry liqueur, which you can purchase in large or small quantities and consume while wading through the strawberry overload. I chose the former option.

A while later, the world looks considerably different from when I first entered the shop. Everybody is friendlier and well, redder. The competitors in the strawberry-eating competition resemble an audition line for a vampire movie.

At one of the stalls I meet Bob and Ina van der Westhuizen. They have given their strawberry liqueur a combo-name without the Van der Westhuizen part: Bobina. They ply their trade on a farm across the (Outeniqua) berg, they tell me. I buy a bottle while the one-man-band launches into Living Next Door to Alice.

It's always been about staying warm in the winter, I reckon. We don't think about it much what with thermostats, natural gas, electricity and solar energy taking care of us, almost behind our backs, but it is a concern.

In the summer of 1879, a total of 23 men arrived in Aspen, at various times and from over Hunter's (Independence) and Taylor passes. A lot of prospecting occurred, but also a lot of time was spent preparing a winter camp and collecting firewood. They knew it would get cold. Ironically, only two stayed through the early winter; irrational fear of the Utes thinned them out, it seems.

Whitley fire leaves man homeless

On the day he turned 40 years old, a Whitley County man is staying with relatives, after a fire destroyed his mobile home in the Whipporwill community Tuesday.

The blaze happened around 9:25 a.m. at the residence of Curtis Hatfield, who owned the 14-by-76-foot single wide mobile home at 100 Osborne Lane, off Whipporwill Road. Hatfield was not at home at the time of the fire, because he had been released from Baptist Regional Medical Center in Corbin, after spending the last few days there due to an attack of kidney stones.

“I was in the hospital, and my friend came to pick me up because I’d been released. My friend got a call on the phone, and the one on the other line said my home was on fire. She said that last year, a record 70,000 students enrolled in their high school Future Farmers of America Program, and that the majority of new interest in farming is from people who don’t come from farming families.

That isn’t to say the small-scale, family farming revolution is a completely youth-driven affair:

“There are lots of people starting whole different lives in their 50s,” Ross said. “And for a lot of the new farmers in California, this is a second career. His book The Friar of Carcassonne: Revolt Against the Inquisition in the Last Days of the Cathars (Walker) intends to make Bernard better known and admired. We have Bernard's story because the inquisition kept it in its archives, when Bernard was finally brought to it for trial and was broken and imprisoned. Bernard was a Franciscan in the convent in Carcassonne, in southern France. The Franciscans of the time were the underdogs to the other mendicant order, the Dominicans who had been founded by a Castillian priest named Dominic. The Dominicans were thought of as "the hounds of God" (from "Domini canes," get it?), and were in charge of the incipient inquisition. This was despite Dominic's seemingly liberal view of his religious opponents. After all, he had invited the heterodox Cathars to debate. The Cathars were a thorn in the side of Catholicism; they preached, for instance, that Catholic sacraments were illegitimate, that Hell was a fabrication, and that the cross was a symbol merely of imperial Roman torture. The Dominican-dominated inquisition held Cathars as a special target, and the Cathars were persecuted by the church in the Albigensian Crusade begun in 1209. The crusade failed to extirpate them from the region of Languedoc, but it ended the region's independence and brought it into France. Those who were tortured and condemned were executed,porcelain tiles or if not executed they were confined within "the Wall," the notorious prison in Carcassonne. Their lands and possessions were confiscated.

Bernard knew unfairness when he saw it. Bernard was a natural leader, with a gift for oratory. He was able to rally the townspeople to storm the prison. He objected that citizens were being left to rot in the Wall, and that years of merciless persecution had rendered his townsmen fractious and distrustful. As Lok Sabha debated and passed the Lokpal bill late on Tuesday, worry mounted in Mumbai over Anna Hazare’s health which deteriorated sharply over the evening.

The viral fever that had laid him low in the days leading up to today’s protest fast spiked to 102 degrees F, and his blood pressure rose. Doctors attending on Hazare said his pulse rate had risen to 98, and he had a cold and a chest infection.

Well past midnight, Hazare’s health remained delicate, and there were indications that he could be moved to hospital from the fast venue at the MMRDA grounds in Bandra-Kurla Complex overnight.

A team of doctors from JJ Hospital visited him and drew his blood for tests. Chief Minister Prithviraj Chavan spoke to him and appealed to him to end his fast. The chief minister said Hazare had told him that he would do as his doctors advise him to.

Officials in Mumbai and Delhi said the government was watching the situation closely. Given earlier experiences with the agitation in Delhi, the government, they said, was wary of appearing to force its will on Hazare, or take any action in a hurry.

Earlier in the evening, Arvind Kejriwal, Hazare’s close aide and member of Team Anna’s core committee, said he had made a fresh appeal to the activist to call off his fast but the 74-year-old was unrelenting.

Kejriwal and fellow activist Kiran Bedi had implored Hazare to end his fast in the morning as well, but Hazare had insisted that the crowds gathered in his support gave him the energy to carry on.

In fact, there wasn’t much of a crowd to speak of.

For an agitation that has always based its claims of legitimacy in numbers, be it at public meetings or on the web, the financial capital provided a significant reality check. The forecast is for similar lows in the coming days.

Following the uncertainties surrounding Hazare’s health over the past few days, a fully equipped team of health specialists was present at the MMRDA grounds. In the morning, Pote had said that although Hazare’s health had improved over the past two days, it continued to be fragile.

“Anna’s blood pressure, pulse and weight is normal as of now. His last meal was yesterday’s lunch. We have advised him to drink plenty of water. Although his fever has subsided, the fluctuating weather condition has caused him a sore throat but overall, his condition is fine,” Pote had said in the morning.

The Beijing smog often keeps Zhushen Zhenyu trapped at home, on his mother’s orders, when he’d rather be playing basketball outside, but the 8-year-old still hopes for a silver lining in the clouds of pollution choking China’s capital.

“When will the air quality be so bad we don’t have to go to school?” he asked a city official one recent smoggy day.

“That depends on government policy,” was the cryptic reply of Li Yunting, an engineer at the Beijing Environmental Monitoring Center, which opened to public visits last month.

The doubts about official pollution data keep piling up for China’s government, as green activists, celebrity bloggers and ordinary citizens increasingly demand action and information to halt the environmental fall-out from decades of breakneck economic growth.

Burning coal is largely responsible for the oppressive smog, which the United Nations has rated the worst in the world. China has more than doubled its coal consumption in the past 10 years but has not kept pace with the clean-air technology found in the West. The past two months have been dire. The high incidence of heavy air pollution has sent many residents rushing to buy face masks, air purifiers and household plants believed to clean dirty air.

The haze has highlighted discrepancies between the government’s robustly sunny statistics and the far scarier numbers recorded and issued by the U.S. Embassy here. Beijing described the air pollution as “light” on December 4, a smog-filled day that forced the city airport, the world’s second busiest, to cancel hundreds of flights because of poor visibility. The embassy reading was “beyond index,” literally off the measurement charts that stop at “hazardous.”

The embassy measurements, begun in 2008 and issued hourly via Twitter, use a standard employed by the U.S. Environmental Protection Agency to measure tiny airborne particles, such as soot from burning gas in cars, that are under 2.5 micrometers in diameter.

Experts consider these particles most damaging to human health, as they are small enough to penetrate the lungs and blood, potentially causing lung cancer and other diseases.

China publishes figures using a standard that measures coarser particular matter such as dust and keeps secret, for internal research, the measurements of smaller particles its scientists collect.

Despite the Chinese government’s blocking of Twitter, the U.S. Embassy figures are widely circulated in Beijing on Chinese websites or microblogs. In recent weeks, celebrity bloggers such as real estate mogul Pan Shiyi and children’s author Zheng Yuanjie have pressured Chinese officials to give a more accurate picture of air quality.

Yu Ping, a Beijing journalist and father of a 6-year-old boy who, like him, has suffered a sore throat in recent weeks, threatens to sue the municipal environmental protection agency if they don’t respond to his request for the recent data.

Some Beijingers, such as Wang Jinlan, say the U.S. government should mind its own business. Her daughter Du Lanxin, 8, says they filled their house with special plants last month to purify the air.

Hua Lei, vice director of the center, insists that, over the past two years, Beijing’s air quality has improved. She says the center measures small particulates in the air but does not release the data because the public “won’t understand the figures.”

Environmentalist Feng Yongfeng, founder of the environmental group Green Beagle, has been lending air-quality monitoring equipment to companies and communities since May.

“As a government, you must let the people know the worst level of air quality,” he says.

Under growing pressure, Beijing is now revising national air-quality monitoring standards and promises to require the release of data on smaller particulates — by 2016.

Circuit breakers

A group of DIY gizmo and robot inventors seek to rewire their futures. Wang Kaihao reports.

The 20-square-meter room is on the second floor of an unassuming building called Fuhao Xiezilou, which literally means, "Office of the Superrich", in Beijing's Xuanwumen area. But the people inside don't look rich, and the messy space doesn't look like a typical office. It's heaped with circuit boards, silicon chips and various electronic components that appear bizarre to laypeople.

This is "Beijing Makerspace", where a group of developers tinker with electronic components to create everything from gizmos to robots as hobbies and careers.

Xiao Wenpeng quit his four-year stint as an IT company programmer in 2005 to start his own business, producing handmade digital devices and developing new silicon chips.

But he found the undertaking tricky to tackle alone.

"I want to meet different people with the same interest in DIY electronics," the 33-year-old says.

"We can make more dreams come true by joining forces."

That's why he opened the Makerspace in 2010. More than 20 young people gather there weekly to exchange ideas and plans to translate their blueprints into electronics.

Website employee Chen Wu says he was inspired after learning about Makerspace through its micro blog.

"It's great to communicate with so many people with the same passion and eagerness for creation," the 32-year-old Beijing resident says.

"I really envied the tech-savvy guys in university, because they would always be invited to the women's dorms to fix computers. That was one of my initial motives to do something cool."

But a lack of materials, DIY experience and time off work suffocate much of Chen's inventive productivity.

However, he uses what spare time he has to read about robots. And in 2008, the man who calls himself "Dynamic Old Boy" online created a miniature robot out of Lego that can solve any Rubik's cube within six minutes.

"When I actually started working on the robot, I found it's not as difficult as I'd expected," Chen says.

"It's just like building with blocks but with electronics."

Chen still shows off his first DIY robot, even though it's not as fast at solving the Rubik's cube as the record holder, which can finish the puzzle in 5.35 seconds.Dimensional Mailing magic cube for Promotional Advertising, Chen's robot is a personal milestone for the self-described "geek".

As a geek, he says he watches many movies, from which he often takes ideas.

He took inspiration from the film Inception, which gave him the idea of using magnetic levitation theory to create a gyroscope.

After watching the Bollywood movie 3 Idiots, he tried to replicate the quadrocopter - an aircraft powered and steered by four propellers - featured in the film. But the process has been anything but smooth.

"The most difficult thing is to keep the aircraft's balance," he says.

"I'm seeking others' advice at Makerspace."

While toy quadrocpoters can be purchased for 1,700 yuan ($269), Chen believes it's much more meaningful to hand-make one,Buy oil paintings for sale online. especially as a gift for his 18-month-old daughter. He believes he can finish it by Spring Festival.

"My greatest wish is to make a 1-meter-tall robot to play with her," he says.

While Chen treats robotics as a hobby, Renmin Univeristy graduate Wang Shenglin treats it as a career.

The 23-year-old finance major didn't search for a job after graduation but rather decided to work full time developing devices at Makerspace.

The Shanghai native has created a 1-meter-multi-touch table that resembles a gargantuan iPad.

"I first saw a multi-touch table made by Microsoft on TV in 2008, but it costs more than $20,000. So, I made my own. We create some interesting devices," Wang adds, pointing to a remote control.

"I could take this to the store and change the TV channels. But I don't want to be a troublemaker. We make stuff like the guys in the The Big Bang Theory," he explains, referring to the hit US sitcom about a group of hyperactively intelligent but socially laggard friends.

"But I'm not a nerd like them."

Wang's past does suggest a relatively hip lifestyle.The EZ Breathe home Ventilation system is maintenance free,

He played on the school's tennis and cricket teams. And he flirted with advertising and even tried his hand at fashion design.

"If I don't try something new and exciting when I'm young, when will I?" he says.

"I ultimately find myself most interested in DIY electronics. My parents completely support me, even though I'm far from home."

But Makerspace faces financial challenges. It must pay a 3,000 yuan ($474) monthly room rental and hundreds of yuan more for materials.Bathroom Floor tiles at Great Prices from Topps Tiles. Testing equipment is also a big expense.

While their inventions may attract popular attention - the multi-touch table was spotlighted at this year's Beijing Design Week - most have yet to capture market demand.

But hope might come from the 3D printer Zhang Ming quit his bank job to invent. The device has aroused investor interest.

"We can't always stay in the lab," Xiao says.

"This project might turn things around."

And Makerspace's inventors and developers believe the 3D printer might be just the start.

The team hosts DIY salons and a book club to brainstorm about the latest technology and its potential. It also plans to organize a carnival next April to encourage more people to try DIY electronics.

Their hope is that those who work in the "Office of the Superrich" might actually live up to their workplace's name.

"The first thing we'll do if we get enough investment," Xiao says, "is move into a bigger office."
