Court jails three Indians for disobeying its orders

Three Indian brothers, who are owners and managers of a plastic wares manufacturing factory in Lagos - Sacvin Nigeria Limited- were yesterday jailed for contempt by a Federal High Court in the state.

The plaintiff said it discovered in June 2009 that Sacvin Nigeria was allegedly selling in Nigeria plastic products with the design of Sacvin, though not its own but closely resembling and identical in design to its products.

It claimed to have been experiencing difficulties in sales as a result of the defendants’ company’s infringement, and was incurring financial loss on daily basis.

The court, on July 9, 2009 granted an interim order restraining Sacvin Nigeria from further engaging in the trade or business of manufacturing and selling or distributing the plastic products and surrender them to the court pending the determination of the substantive suit.

The defendants ignored the said orders and went ahead with its business, a development that informed the contempt proceedings.

Vik Industries’ lawyer, Chukwudi Enebeli told the court while arguing his application yesterday that the defendants disobeyed the July 2009 orders with impunity and engaged in manufacturing, importing, supplying, selling and distributing the plastic products.

Enebeli consequently urged the court to commit the defendant company’s directors, who were in court, to prison for disobeying the order of the court. He said if they were not penalized, they will persist in disobeying the order of the court.

Defence lawyer, Dan Olowojaiye, who did not file any counter motion to the contempt proceedings,Why does moulds grow in homes or buildings? argued that the directors cited for contempt were not personally served with the court’s orders.

He claimed that the said contempt was carried out by the company and not the directors, an argument Enebeli countered, insisting that it was the court’s directive that the orderwas to paste it at the premises of the court. He added that the directors are the directing minds of the company.

Justice Tsoho upheld Enebeli’s argument and held that the directors, being the directing minds of a company, are liable for any act committed by the company.

The judge rejected the defence lawyer’s suggestion that his client be given an option of fine on the ground that it will make a mockery of the judicial system and consequently sentenced the three directors to a month imprisonment.

Dwolla raises $5 million, stays in Des Moines

Dwolla grew out of Milne’s frustration at credit card fees, and his goal has been to simplify those fees and make transactions safer.

Milne said the lead partnership between Dwolla and Union Square almost fizzled thanks to what Milne called a “philosophical disagreement” he declined to discuss.

“Any time you are looking at doing a business deal or partnership, there are always going to be disconnects,” Milne said. “Albert and me, we had a strong disconnect. I misunderstood what he was saying and said, ‘It’s a dead deal.’ ”

Clinton native, Disney actor Daniel Curtis Lee eyes rap career

Daniel Curtis Lee has learned the power of television.

"One day, a couple of girls will speak to you," he says. "The next day, a couple of more. The next day, a lot more. And then after a while, just about all of them are speaking."

The 20-year-old actor from Clinton who resides with his parents in Long Beach, Calif. has built a solid acting resume.

He is one of the stars of Zeke and Luther, which airs on Disney XD at various times throughout the week. It is the longest running original series on the cable network and the first to reach three seasons. Daniel plays the role of Cookie, a loud-mouthed, cocky skateboarder.

And on his first audition, with no formal training, he earned a bit part in the 2002 comedy Friday After Next, which starred Ice Cube.

"Never did we see this coming for Daniel," says Sharial, who teaches reading to special needs students at Millikan High School in Long Beach. "He was always into sports, always wanted to be outside playing football or basketball."

But he was a natural at auditions. Scott Fellows, executive producer and creator of Ned's Declassified School Survival Guide, told The Clarion-Ledger shortly after Daniel earned the role: "He had a nice confidence about him. Very relaxed."

When Fellows learned that Daniel had been part of a gospel choir back home in Clinton, he asked the 13-year-old actor to belt out a hymn.

He did so without hesitation.

Donor recipients’ remarkable stories

CYSTIC fibrosis sufferer Robbie Black's life was saved by a transplant — and he repaid the favour to another dying patient by donating HIS own heart.

Robbie desperately needed new lungs and when a pair became available he was overjoyed.

But he was also given a new heart as it's easier for doctors to replace the major organs at the same time.

And his healthy ticker was then donated to a young girl — meaning TWO lives were saved by one tragic donor's final gift.

Last night grateful Robbie, of Inverness, said: "Instead of three people dying, one person saved two people by donating their lungs and heart.

"It was easier to do the triple transplant than just the lungs, but instead of throwing my perfectly good heart away someone else is also alive today."

Hospitality worker Robbie was only 16 when his life hung in the balance.

He said: "My health deteriorated rapidly in my teens. At 16 I was close to death — although I didn't know it.We are passionate about polished tiles. My parents went through hell.

"I was sleeping all the time but I was too ill to care what was happening. It started with me feeling very tired then struggling to breathe.

"Then it all went downhill to the point that I was told I needed a double lung and heart transplant.

"It's not something you expect to hear at 16, but my family were a great support to me."

At this stage, Robbie was so ill and weak he likely wouldn't survive such intensive surgery.

He added: "Somehow I managed to hang on in there and became strong enough to be put on the transplant waiting list."

It was another 15 months before a donor became available and, unbeknown to Robbie, doctors feared he wouldn't live until his next birthday.

He said: "I was blissfully unaware of any of it. Transplantation is common for people with cystic fibrosis but you never think it will happen to you. I couldn't live the life of a normal 16-year-old boy. I missed most of my fifth year at school.

"But I had a great group of friends around me who cheered me up when I needed."

The life-changing call Robbie's family had been waiting for finally came one ordinary night as he watched football on television in February 1999.

He said: "It was a big, big deal but I was the only one who was calm."

He added: "Unfortunately, bad weather meant the organs were stuck in Liverpool so it took about five hours to get them to Great Ormond Street because the snow was so bad. My parents were so nervous, but I was sleeping most of the time, so it was really them who suffered much more than me.

"I must have been told that when the double lung and heart went in, my own heart would be going to someone else, but I don't really remember.

"I know I'd have agreed like a shot because what good was it to me? It was a brilliant idea."

Despite having underwent major surgery and spending seven weeks in hospital, Robbie was delighted at the prospect of enjoying his life again — and to have saved someone else's.

"I will always remember the donor who died and be eternally thankful someone thought of people like us.

"It's the most wonderful gift I could ever give — or receive."

Not just a farm on Magnificent Hill

Jump ahead a few years and the chickens have their own coop. There are also vegetables from the garden, milk and cheese from the goats; there are fruit trees and pigs. Piece by piece, Kilter has been simultaneously building a farm and dismantling her reliance on grocery stores.

Diane Doiron joined Lea in 2007. Living part time in Toronto, Doiron spends free time with Kilter making decisions and working the land; together, they're the brains and sweat behind the Hill. Nowadays, they have reserves of rain water for the gardens, grapevines for wine, bees to pollinate and produce honey, meat from chickens, goats and pigs; they are tapping maple syrup and preserving vegetables from the farm's garden.

But, "it's not just a farm," Kitler said walking to a concrete foundation for a structure in the works. It represents the next step forward. It will function as an outdoor kitchen when finished. AS the Grouse Mountain Skyride climbs through late June mist, the stress of traffic, deadlines and unfinished errands drops away into the trees along with the fat raindrops.

Once we're in the alpine it's quiet, the air still and cool. The city unrolls below like a still life in muted shades of concrete, glass and sky.

No wonder the mountain made it onto a list of local "sacred sites" at which to enjoy a glass of wine, compiled by Sacred Hill Winery.

Before arriving at Grouse Mountain, this group of wine and food writers, chefs, bartenders and sommeliers sampled several bottles of the New Zealand winery's latest releases at other sacred spots around town, including English Bay and Stanley Park, led by Sacred Hill chief winemaker Tony Bish.

The tour was obviously a play on the winery's name; a bit gimmicky, true,Save on hydraulic hose and fittings, but effective. As clich¨¦d as it is, there is always value in slowing down and enjoying where you're at.

And these wines are worth slowing down for.

The 2010 Sauvignon Blanc from the Marlborough region is classic Kiwi, fresh and racy, perfect for summer sipping.

The 2007 Sauvage Sauvignon Blanc is entirely different, not least because it's had a few years in the bottle. Made with grapes from Hawkes Bay, it's naturally fermented with indigenous yeasts (hence the "sauvage" moniker) and aged in oak for 10 months.Full color plastic card printing and manufacturing services. The Pen

Originally, my impression of the HTC Scribe Pen was one of necessity. I even went so far as to comment that without it, you shouldn't even bother getting one. After spending some time with it, however, I see that the way the pen interaction is (or isn't,The newest Ipod nano 5th is incontrovertibly a step up from last year's model, in most cases) integrated into the UX being only for pretty specific users. For me it's great, since I take screenshots and like to doodle little horns and black eyes on pictures of my wife. The Flyer doesn't include any kind of MS Paint like app to just simply doodle on,we supply all kinds of oil painting reproduction, but instead seems to resign the capabilities of the Pen to basic note taking and communication.

Since the pen's usage is so limited, it would have made a lot more sense for it to have a home on, in, or near the tablet in some way. Since that's not the case, I don't see many people bringing the pen with them anywhere and just using it at home. Since replacing one is (another) $80, you aren't likely to just keep it in your pocket or behind your ear for no good reason. So, is the pen cool? Performance

Despite not being a dual core device, the Flyer handles itself very well when compared to dual core Honeycomb devices. With half the boot time of the LG G-Slate and a third of the Xoom's boot, the tablet holds its own. Loading any app happens just as fast on the Flyer, and you can't ask for a smoother navigation on a tablet. The Dual Core tablets are simply not generating anything more than what a well made, well optimized single core tablet is able to bring to the table right now.

The battery life is great on this device as well. Being a 7-inch device it's going to consume a lot less power than the larger tablets, but you've also got less space to fill with battery. I was able to get 14 hours of battery life in a day where I beat Plants vs Zombies from beginning to end and downloaded and watched a movie from HTC Watch, the movie rental and purchase market from HTC. I would tell you what its standby battery life is, but since I'm unable to keep my hands off of it, I can't tell you. The specs sheet offers a ridiculous 1400 hour standby, which would be truly insane if it were true.

Final Thoughts

The HTC Flyer is the closest thing to a complete thought I have seen since tablets became a thing. The device combines power and performance with an all day battery and a thoroughly enjoyable user experience. There's no messing with a whole new user experience, and all of the apps that I like so much on my Android phone not only work on the Flyer but actually look good. The Flyer may have a special power cable for changing at the correct voltage, but the tablet still charges via USB, something I have yet to see from the other major tablets.

I see the Flyer as being a clear cut example of what happens when you sit back and watch the other guys make their mistakes before releasing a quality product. Knowing that HTC has plans for a 10-inch tablet in the not-so-distant future, my suggestion to the other players in the tablet game is to get it together before HTC comes in and dominates yet another market.
