Court jails three Indians for disobeying its orders

Three Indian brothers, who are owners and managers of a plastic wares manufacturing factory in Lagos - Sacvin Nigeria Limited- were yesterday jailed for contempt by a Federal High Court in the state.

The plaintiff said it discovered in June 2009 that Sacvin Nigeria was allegedly selling in Nigeria plastic products with the design of Sacvin, though not its own but closely resembling and identical in design to its products.

It claimed to have been experiencing difficulties in sales as a result of the defendants’ company’s infringement, and was incurring financial loss on daily basis.

The court, on July 9, 2009 granted an interim order restraining Sacvin Nigeria from further engaging in the trade or business of manufacturing and selling or distributing the plastic products and surrender them to the court pending the determination of the substantive suit.

The defendants ignored the said orders and went ahead with its business, a development that informed the contempt proceedings.

Vik Industries’ lawyer, Chukwudi Enebeli told the court while arguing his application yesterday that the defendants disobeyed the July 2009 orders with impunity and engaged in manufacturing, importing, supplying, selling and distributing the plastic products.

Enebeli consequently urged the court to commit the defendant company’s directors, who were in court, to prison for disobeying the order of the court. He said if they were not penalized, they will persist in disobeying the order of the court.

Defence lawyer, Dan Olowojaiye, who did not file any counter motion to the contempt proceedings,Why does moulds grow in homes or buildings? argued that the directors cited for contempt were not personally served with the court’s orders.

He claimed that the said contempt was carried out by the company and not the directors, an argument Enebeli countered, insisting that it was the court’s directive that the orderwas to paste it at the premises of the court. He added that the directors are the directing minds of the company.

Justice Tsoho upheld Enebeli’s argument and held that the directors, being the directing minds of a company, are liable for any act committed by the company.

The judge rejected the defence lawyer’s suggestion that his client be given an option of fine on the ground that it will make a mockery of the judicial system and consequently sentenced the three directors to a month imprisonment.

Green is the new black at London's eco fashion event

Carbon-friendly couture will come under the spotlight today at a green fashion event organised by the University of East Anglia (UEA) with fashion students from London’s Kingston University.

''If you can't pay it in the interest free period, be aware of how much interest it's going to cost you,'' says Fox.

Not everyone can or wants to follow the golden rule. For those that don't, at least make the switch to a plain, no-frills card. All the big banks offer them, and the usual 13 per cent interest rate is a big saving from an average of 19.6 per cent charged to standard cards.

American wallets are bulging at the seams with credit cards, not cash. Fox groans when asked if multiple credit cards are a good idea.

A crippled snail crawling through an olympic swimming pool of treacle moves a lot faster than debt paid off by minimum monthly payments.

It's like running in place - barely keeping up with interest, taking forever to pay off the debt, and ending up paying far more than you would have.

It can be a pretty depressing situation, says Fox.

''We do see people that are paying the minimum monthly amount, and are then getting charged interest each month and virtually going nowhere with the repayments.

''The debt never goes down, or goes down very, very slowly.''

Businesses used to wear the transaction cost charged by credit card companies, but now they're allowed to pass that on to consumers. This usually crops up with smaller fees, like taxi fares or parking. It's usually not much, but it all adds up.

It's best to carry cash or eftpos for the small stuff, and save the credit card for big ticket items.

There's no doubt credit cards can be handy for navigating through temporary cashflow crises such as when you spend the last of your paycheque, then remember you didn't buy mum a Christmas present.

But sometimes, says Fox, emergencies can snowball into even bigger disasters.

''Credit cards are a good backstop for a crisis, but then you have to plan how you're going to pay it back, or it can really quickly get out of hand,'' she says.

And that's the key message - what really matters is having a plan to pay off any debt you rack up before the interest kicks in.

If you can do this, you can ignore the other nine tips. That's a pretty big 'if', though. The rest of us mere mortals are often somewhat lacking in the budgeting and self-discipline departments. And if that's the case, the 10 tips still stand.

Last night grateful Robbie, of Inverness, said: "Instead of three people dying, one person saved two people by donating their lungs and heart.

"It was easier to do the triple transplant than just the lungs, but instead of throwing my perfectly good heart away someone else is also alive today."

Hospitality worker Robbie was only 16 when his life hung in the balance.

He said: "My health deteriorated rapidly in my teens. At 16 I was close to death — although I didn't know it.We are passionate about polished tiles. My parents went through hell.

"I was sleeping all the time but I was too ill to care what was happening. It started with me feeling very tired then struggling to breathe.

"Then it all went downhill to the point that I was told I needed a double lung and heart transplant.

"It's not something you expect to hear at 16, but my family were a great support to me."

At this stage, Robbie was so ill and weak he likely wouldn't survive such intensive surgery.

He added: "Somehow I managed to hang on in there and became strong enough to be put on the transplant waiting list."

It was another 15 months before a donor became available and, unbeknown to Robbie, doctors feared he wouldn't live until his next birthday.

He said: "I was blissfully unaware of any of it. Transplantation is common for people with cystic fibrosis but you never think it will happen to you. I couldn't live the life of a normal 16-year-old boy. I missed most of my fifth year at school.

"But I had a great group of friends around me who cheered me up when I needed."

The life-changing call Robbie's family had been waiting for finally came one ordinary night as he watched football on television in February 1999.

He said: "It was a big, big deal but I was the only one who was calm."

He added: "Unfortunately, bad weather meant the organs were stuck in Liverpool so it took about five hours to get them to Great Ormond Street because the snow was so bad. My parents were so nervous, but I was sleeping most of the time, so it was really them who suffered much more than me.

"I must have been told that when the double lung and heart went in, my own heart would be going to someone else, but I don't really remember.

"I know I'd have agreed like a shot because what good was it to me? It was a brilliant idea."

Despite having underwent major surgery and spending seven weeks in hospital, Robbie was delighted at the prospect of enjoying his life again — and to have saved someone else's.

He said: "I can't explain what it feels like to be told your transplant is going ahead.Why does Plastic moulds grow in homes or buildings?

"It was scary but exciting at the same time. It all seems like a bit of a dream now.

"I have seen and experienced both sides of organ donation, which is very unusual.

"It's the most wonderful gift I could ever give — or receive."

House committee seeks new tax on cellphones to support 911 call centers

A House committee is revisiting a cellphone tax to remedy diminishing funds for 911 call centers in Missouri. The call centers are supported by an existing tax on landlines; the measure would also impose a tax on cellphones.

This is the third time the legislature has attempted to implement this tax. Both previous attempts were rejected by Missouri voters.

The committee is drafting a bill to implement the tax for January's upcoming legislative session. Schools opened in Middletown on Wednesday, Sept. 14, and a boil-water advisory was lifted the next day.
Counselors were available at Middletown schools to help kids deal with the flood.

At a Red Cross shelter in the Church of God in Middletown, 4-year-old Aiden Vandergrift sings songs with Christine Porter, administrator of the Middletown Public Library, who arrives nightly to entertain children who had to flee their homes. He effervescently signs "The Wheels on the Bus'' with Porter, but when she sings the first few stanzas of a song about the ocean, he protests.

After people groggily packed up their bedding and lined up for dumpster-dived bagels, the meeting began. Its purpose was a run-down of the day’s events. For almost two hours the march continued, continually evading attempts by the police to pin them in or guide them out of the area by making sudden turns and course reversals. Just as the barricades on Broad Street were opened to let them out and keep them out, they turned around and headed back up toward the Stock Exchange and along Wall Street. (This was when Democracy Now! called me for a report.) Then, after marching around the Exchange on all sides, the crowd turned into a long, two-directional picket line along Wall Street, going back and forth and back and forth as the opening bell was rung. "Ring! The! Bell!" they cried. With so many occupiers out, scouts made sure to check that there were still enough in Liberty Plaza to hold it.

Most bystanders and commuters in the midst of the march weren’t amused. (The goal wasn’t to amuse them.) "Shit" was something I heard a lot. Beacon of hope

LOCATED on a small hilltop at Chwee Chian Road, off Pasir Panjang Road, Poh Ern Shih (Temple of Thanksgiving) is probably the first religious building in Singapore to display great zeal and determination in becoming green.

Facing Singapore's southern coast on one side, and the famed Bukit Chandu on another end, the temple was built as a memorial to those who lost their lives during the Battle of Pasir Panjang in 1942, which was fought just a week before the British surrended their "Gibraltar of the East" to the Japanese.

Established in 1954 as a modest single-storey temple by philanthropist Lee Choon Seng (who passed on in 1966 at 78 years old), Poh Ern Shih is one of the few Chinese Mahayana temples in Singapore dedicated to the Ksitigarbha, one of the four principal bodhisattvas in East Asian Mahayana Buddhism (the others being Samantabhadra, Manjusri, and Avalokitesvara).

The original temple structure was demolished in 2003 in order to expand the temple complex, and the first phase of renovations was finished in 2007. To the honorary president of the temple, Lee Boon Siong (the founder's grandson), this presented a marvellous opportunity to incorporate eco-friendly features into the new wing.

Lee, a retired lawyer who spent many years in Canada after leaving Singapore in 1988, said that he learnt many aspects of being green during his sojourn there. Upon his return to Singapore in 1995, he was asked to be a director of the temple board, which is funded entirely from donations and gifts.

"I met up with Lee Coo, a green-minded architect who has produced many sensible designs, and we began to discuss on how we could work together,'' said Lee, 72. Both shared the vision of making Poh Ern Shih a green temple, by taking a comprehensive approach that will encompass solar radiation, water, wind, recycling and so on.Enecsys Limited, supplier of reliable solar microinverter systems,

Like the other Marvel Pinball tables

Captain America is the newest superhero to join the collection in Marvel Pinball for the PS3 (and Pinball FX2 for the Xbox 360). The table is inspired by Ed Brubaker's Captain America 65th Anniversary Special (from 2006) and is World War II themed. The table itself sits in the rear of a cargo plane, which you can see by looking at the edges of your screen,A glass bottle is a bottle created from glass. which is just a finishing touch on the excellent art style. Barbed wire and tank traps line the borders of the table, and bomb shells and rifle shots will erupt from the table as you hit the bumpers and kickers. Its design is simply fantastic, but that's no surprise: Zen Studios always nails the visuals and sounds on their tables, and this newest DLC is no exception.

Captain America stands proudly at the rear of the table, wrapped head to toe in the American flag, and bearing his signature shield. As you play, Captain America will pose, flex, and do other typical superhero actions, but once you begin the game missions he will really get active. In most of the missions, Captain America will get personally involved, acting out what your ball is doing on the playfield. Captain America's foes also make appearances on the playfield. The Sleeper will become activated when you disturb the Cosmic Cube too much, and try to pummel Cap to the ground.

Like the other Marvel Pinball tables, these 3D characters make a very large appearance on the table, and interact with most of the missions. I often found the characters distracting and out of place, however this time I must congratulate Zen. They have done a much better job integrating the characters and giving them more subtle animations, so it doesn't look like midgets are dancing around the table while you are trying to play. Captain America and his foes look vastly better and have smooth animations to back up the detailed models.

The table contains 10 missions containing the standard pinball objectives; hit these targets, shoot this ramp, etc. However Zen Studios always impresses with a few unique touches. When Zemo deploys his Adhesive X, green goop is sprayed onto certain parts of the table and will slow your ball if you roll through it; and once you destroy the canisters in that area the goop will disappear.

However the best feature of this table is the Cosmic Cube. Sitting next to Captain America is his version of the magic genie, the Cosmic Cube. If you hit the barriers shielding it, you can activate the cube and it will grant Cap a "wish" and help you out. If you are in the middle of a mission,The newest Ipod nano 5th is incontrovertibly a step up from last year's model, you can hit the cube and it will teleport the ball to a certain location on the field and complete an objective automatically. It is very useful when you are having trouble with a certain mission and need a freebie. I really love the addition of this feature because it takes advantage of the fact that you are playing a pinball videogame. The Our Lady of the Sierras Shrine has been a popular tourist/religious attraction for over two decades and was opened to the public in 1998. Monument Fire shows signs of abating

Now having consumed more than 19,000 acres of Arizona desert, the Monument Fire has become more manageable following two rough days of hot, windy weather.

With the Type 1 Management Team cautiously giving a 15% containment on the Monument Fire and the weather working with them, instead of against, in the form of reduced winds, the fire has begun to slow down and is currently primarily in the Miller Canyon area. With only one reported injury, a firefighter was treated for smoke inhalation, the residents of the threatened areas have, for the most part, heeded the evacuation orders given by the Cochise County Sheriff's Department. However, there were several residents refusing to leave and it is unknown at this time if they eventually departed.

Fort Huachuca Fire

Fort Huachuca, the Army's Military Intelligence training base, reported a fire early yesterday afternoon. Initially, it was thought to be related to the Monument Fire but it was later discovered the cause was due to a bulldozer creating sparks and igniting the tinder-dry grasses around it. With no recordable rainfall since December, 2010, severe drought conditions exist and the Coronado National Memorial, part of which abuts the fort, was closed to the public three days prior to the ignition of the Monument Fire.

The Red Cross is sharing with reporters the overwhelming response from both the community and the surrounding communities with regard to goods and are now asking for monetary donations only. Year Agreement as Preferred EPC Provider of up to 300 Megawatts in Projects for KDC Solar in New Jersey and New York

In December 2010, SPI announced it had been selected to build a 5-megawatt SEF at the White Rose Foods facility located in Carteret, New Jersey. KDC Solar is the Managing Member of this project. Following the close of this transaction, SPI and KDC Solar began discussing a broader preferred provider arrangement which led to this agreement. According to KDC Solar, its current pipeline in the New Jersey market already exceeds 150 megawatts. If fully developed, this pipeline alone is expected to generate approximately $600 million of new EPC and O&M business for SPI over the 3-year term of the agreement. As the Northeast market continues to develop, and KDC Solar pursues additional pipeline opportunities in the region, up to 300 megawatts of projects could come to fruition under the agreement.
